Can one of my attorneys change my will?

 

Lasting Powers of Attorney are very important if not essential documents for the safe management of later life. If you lose mental capacity through accident, illness or age and you do not have LPA’s (Lasting Power of Attorney) in place the Office of the Public Guardian, ie. the Government, will take control and make all decisions on your behalf concerning your finances and your health and welfare until a deputy can be arranged ( a costly and time consuming exercise).

The attorneys you choose if you have LPA’s in place will essentially be your legal voice and have the authority to manage your finances and health and welfare issues as if they were you. However, they may be acting as your legal voice but cannot change your will that was created and signed and witnessed before you lost mental capacity.

If you are currently without LPA’s our advice would be to consider, especially after the Covid 19 epidemic we’re all dealing with, would be to have someone or more than one person, in place to act on your behalf should disaster strike.
